After arriving in the U.S., many students may start to wonder:
"Can I change my status while staying in the U.S.?"
The answer is: Yes!
This brings us to todayās topic: Change of Status (COS).
š What is Change of Status?
It means changing your non-immigrant status to another type of non-immigrant status without leaving the U.S.
Examples:
B2 Tourist ā F1 Student
F1 Student ā H1B Worker
F2 Dependent ā F1 Full-time Student
š Note:Ā Change of Status ā Getting a New Visa
A visaĀ is your entry permit (in your passport).
StatusĀ refers to your legal stay within the U.S.
š¤ Who Can Apply for COS?
You may be eligible if you:
ā Are in valid immigration status
ā Have not violated visa terms (no unauthorized work or overstay)
ā Have a legitimate reason (study, work, family changes, etc.)
ā Can financially support yourself
ā ļø Who Cannot Apply?
ā Overstayed your I-94
ā Entered with C (transit), D (crew), or K (fiancĆ©) visas
ā Entered under Visa Waiver (WT/ESTA)
ā Have immigration intent that violates current status
š Examples:
Mr. Wang enters on a B2 and wants to study English ā B2 to F1
Ms. Li holds F2 but wants to study full-time ā F2 to F1
Mr. Zhang finishes school on F1 and is hired ā F1 to H1B
