🗽How to Change Your Status in the U.S.? | Part 1: What is a “Change of Status”?

After arriving in the U.S., many students may start to wonder:

"Can I change my status while staying in the U.S.?"


The answer is: Yes!

This brings us to today’s topic: Change of Status (COS).



🔍 What is Change of Status?


It means changing your non-immigrant status to another type of non-immigrant status without leaving the U.S.


Examples:

  • B2 Tourist → F1 Student

  • F1 Student → H1B Worker

  • F2 Dependent → F1 Full-time Student



📌 Note: Change of Status ≠ Getting a New Visa


  • A visa is your entry permit (in your passport).

  • Status refers to your legal stay within the U.S.




👤 Who Can Apply for COS?


You may be eligible if you:

✅ Are in valid immigration status

✅ Have not violated visa terms (no unauthorized work or overstay)

✅ Have a legitimate reason (study, work, family changes, etc.)

✅ Can financially support yourself



⚠️ Who Cannot Apply?


❌ Overstayed your I-94

❌ Entered with C (transit), D (crew), or K (fiancé) visas

❌ Entered under Visa Waiver (WT/ESTA)

❌ Have immigration intent that violates current status


📚 Examples:

  • Mr. Wang enters on a B2 and wants to study English → B2 to F1

  • Ms. Li holds F2 but wants to study full-time → F2 to F1

  • Mr. Zhang finishes school on F1 and is hired → F1 to H1B
